1. When is a notification sufficient for a container on a plot?
A notification to the local authority is sufficient for temporary installation of a container, when:
✅ It is not permanently attached to the ground (no foundations, easy to relocate)
✅ It will be used for no longer than 180 days in one location
✅ It is not intended for permanent residence
✅ It is not located in a restricted or protected area (e.g., Natura 2000 zone)

You can submit it at the County Office (Starostwo Powiatowe) or City Hall (Department of Architecture and Construction). The notification should include:
📄 the location of the container
📄 its purpose (e.g. storage, office)
📄 the planned duration of use (up to 180 days)
📄 a site plan or sketch showing the exact placement of the container

A private person wants to place a container on a recreational plot to store tools and gardening equipment during spring and summer. The container will have no foundations and will be removed after 5 months. Because it is a temporary structure, a simple notification to the city office is sufficient, and no building permit is required.
Containers used as temporary construction facilities, not permanently attached to the ground and used only during the construction period, do not require either a notification or a building permit.

2. When is a building permit required?
A building permit is required if the container will be used for more than 180 days or meets one of the following criteria:
🔹 It is permanently attached to the ground (with foundations)
🔹 It is connected to permanent utilities (electricity, water, sewage)
🔹 It serves as a permanent residential, office, or other fixed-use building
🔹 The built-up area exceeds 35 m² (applies to residential or office containers)
🔹 Local regulations require a permit (e.g. zoning plan or protected area restrictions)
📌 How to obtain a building permit?
The process is more complex than notification and requires:
📄 a building design prepared by an architect
📄 a zoning decision (if there is no local development plan)
📄 a building permit application submitted to the county office
📄 technical opinions (e.g. from the sanitary or fire department – in selected cases)

An individual wants to place a residential container connected to water and electricity.
Since the container will remain permanently and serve as a home, a building permit is required.

3. What happens if you place a container without notification or permit?
If the container is placed without the required formalities, it may be considered unauthorized construction, which can result in legalization procedures (often more expensive than obtaining approval in advance) or even an order to remove it.
